The European Patent with Unitary Effect is an opportunity for SMEs operating in international markets, but it requires a strategy and increased attention to IP rights management.
Businesses with high growth potential in foreign markets need international agreements that allow them to operate with confidence. Obtaining an intellectual property right such as a patent in a specific country can provide protection, but there are costs related to nationalization and issuance times that sometimes hinder its implementation. While the European Patent already offered some advantages in this regard, the introduction of the European Patent with Unitary Effect has brought further benefits. The European Patent with Unitary Effect is, in fact, an opportunity for businesses in terms of time and cost, but it requires a paradigm shift and greater attention to the management of industrial property rights. The Unitary Patent will automatically register the title at a reduced cost in all countries that have ratified the agreement, and therefore, a more accurate monitoring of the freedom to operate in these countries will be necessary.
